The Free Speech For People nonprofit filed the suit arguing the former president is ineligible because of the 14th Amendment's insurrection clause, his attempt to overturn the 2020 election results, and his encouragement of the January 6, 2021 attack on the Capitol. Under it any public official who "engaged in insurrection or rebellion" or gave "aid or comfort" to insurrectionists is disqualified from holding that office again. This is one of several cases filed by this group in other states.
