He reiterated that the President's executive order is "fully lawful" and "ultimately will be upheld by the Supreme Court."

The Court, in a unanimous, unsigned ruling wrote, "The Immigration and Nationality Act gives the President broad powers to control the entry of aliens, and to take actions to protect the American public. But immigration, even for the President, is not a one-person show. The President's authority is subject to certain statutory and constitutional restraints. We conclude that the President, in issuing the Executive Order, exceeded the scope of the authority delegated to him by Congress." This is the second appellate court to rule against President Trump's revised travel ban. The Fourth Circuit Court of Appeals ruled against the ban in May.
