United States v. Sineneng-Smith Oral Argument
1 hour, 2 minutesThe Supreme Court heard oral argument for a case concerning the constitutionality of a federal law forbidding encouragement of illegal immigration. Evelyn Sineneng-Smith, an immigration consultant out of California, was convicted of telling her undocumented clients that they could still gain lawful permanent residence through a program called Labor Certification, even though she knew the program ended in April 2001. Federal law forbids such encouragement. Federal officials charged Ms. Sineneng-Smith and she was later convicted by a jury. She appealed her conviction to a federal court of appeals, and they ruled in her favor citing that the law was overbroad in violation of the First Amendment. The federal government appealed to the Supreme Court. The justices now have through June to issue a ruling.
