This case hinged on the so-called independent state legislature theory--which argues the Constitution permits state lawmakers to set laws for congressional and presidential elections unchecked. Chief Justice John Roberts authored the majority opinion, and Justice Clarence Thomas wrote the dissenting opinion. The nation's highest court heard oral argument in Moore v. Harper back in December 2022. This case stemmed from North Carolina's 2021 congressional map that was approved by the Republican-controlled state legislature. Lawsuits were filed, challenging it on the basis it was gerrymandering in favor of the GOP, which is prohibited in North Carolina. The state Supreme Court agreed and blocked its use in the 2022 midterm elections. A new map was eventually completed by Court-appointed experts and used in the elections
