In a 5-4 decision, the Supreme Court struck down a Louisiana law requiring abortion doctors to have admitting privileges at a hospital within 30 miles of the facility where the procedure is done. Justice Stephen Breyer wrote the majority opinion joined by Justices Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan. Chief Justice John Roberts also in the majority authored a concurring opinion. Justice Clarence dissented along with Justices Samuel Alito, Neil Gorsuch and Brett Kavanaugh. The court heard oral argument in March 2020. Under the Louisiana law, physicians who violate it would face penalties including prison time, fines, losing their license to practice and civil liabilities. Prior to the law taking effect in 2014, the state's two out of six physicians who perform abortions filed suit and argued the law violated their due process rights and also their patients right to an abortion.
