This is a win for the Asian American rock band the Slants who challenged the U.S. Patent and Trademark Office's refusal to trademark the name of their band because the name can be seen as a racial slur disparaging to people of Asian descent. The Court found the disparagement clause of the Lanham Act, a 1946 trademark law that bars the federal registration of trademarks that "disparage" groups and individuals, an unconstitutional violation of First Amendment free speech protections. Justice Alito in his opinion for the Court wrote, "The disparagement clause is not 'narrowly drawn' to drive out trademarks that support invidious discrimination. Missouri has a state program that provides grants to resurface gravel playgrounds with a rubber surface made from recycled tires. Trinity applied for one of the grants but was denied because the state's constitution barring public funds from going directly or indirectly to a religious entity. Chief Justice Roberts in his opinion for the Court wrote, "The exclusion of Trinity Lutheran from a public benefit for which it is otherwise qualified, solely because it is a church, is odious to our Constitution all the same, and cannot stand."
