The Supreme Court ruled unanimously people or businesses facing Securities and Exchange Commission (SEC) enforcement actions can challenge the agency's legal proceedings in federal court prior to the investigation being completed. The justices heard oral argument in SEC v. Cochran in November 2022. Michelle Cochran, a certified public accountant, filed the suit. The SEC accused her of auditing violations between 2010 and 2013. Following a SEC hearing, an administrative judge ruled against her, imposed a more than $22,000 fine, and banned her from practicing for five years. As in the Axon Enterprise case, Ms. Cochran's lawsuit alleged constitutional violations. The SEC is a federal regulatory agency tasked with enforcing laws prohibiting market manipulation.
