The acting director also confirmed the suspected shooter, Ryan Wesley Routh, did not fire or get any shots off. U.S. Attorney for the Southern District of Florida Markenzy Lapointe announced federal charges were filed against Mr. Routh for firearms offenses, including "for possession of a firearm by a convicted felon and possession and receipt of a firearm with an obliterated serial number."

Attorneys Andrew Pincus and Jeffrey Fisher, who respectively represented ByteDance and content creators, argued that the law was unconstitutional under the First Amendment. Justice Department appellate attorney Daniel Tenny, however, argued that TikTok presented national security concerns with regard to data collection and content manipulation.
