Texas v. United States Health Care Law Oral Argument
1 hour, 49 minutesA three-judge panel out of the Fifth Circuit Court of Appeals in New Orleans has ruled the health care law individual mandate unconstitutional. The court heard oral argument for the State of Texas et al. v. United States et al., back in July 2019 and considered whether the law is invalid after Congress in 2017, under the GOP tax law, repealed the individual mandate penalty. Judge Jennifer Elrod had the opinion for the court and said "it can no longer be read as a tax, and there is no other constitutional provision that justifies this exercise of congressional power." Judge Carol King dissented and would've dismissed the case all together. She wrote, "I would vacate the district court's order because none of the plaintiffs have standing to challenge the coverage requirement.
