2 hours, 13 minutesThree Ninth Circuit Court judges testified on Capitol Hill before the House Judiciary Subcommittee on Courts on whether the Ninth Circuit - the largest in the country - should be split. Ninth Circuit Chief Judge Sidney Thomas and Judges Carlos Bea and Alex Kozinski all said no. The circuit has come under scrutiny recently for refusing to reinstate President Trump's ban on travelers from seven prominantly Muslim nations prompting the administration to release a new narrower ban. The new ban was blocked by a U.S. District judge in Hawaii, which is also in the Ninth Circuit.

A group of coal miners joined the President on stage for the executive order signing.

In 2002, the Supreme Court ruled that executing a "mentally retarded" person violated the Constitution's Eighth Amendment ban against cruel and unusual punishment. In 1980 Bobby Moore was convicted and sentenced to death for shooting and killing a Houston store clerk in a robbery. After numerous court proceedings, a lower court judge ruled Moore intellectually disabled and ineligible for the death penalty. The Texas Court of Criminal Appeals reversed that ruling, citing the lower court judge's use of current medical standards in defining intellectual disability, not the 1992 standards set by the Texas Court of Criminal Appeals. The Supreme Court's decision reverses the Texas Court's ruling that Bobby Moore was not intellectual disabled. Much of their focus was on the impact budget restrictions -- many of them related to the 2011 Budget Control Act -- had on the U.S. military's overseas offensive and defensive abilities. Many of the subcommittee's lawmakers questioned the two Pentagon leaders about how various budget cuts would affect military installations or projects in their states, as well. Senator Thad Cochran (R-Mississippi), chair of the subcommittee and full Senate Appropriations Committee, said the subcommittee would return in a week to continue work on its fiscal year 2017 appropriations bill.
