Supreme Court Opinion in Race-Based Admissions at Colleges & Universities

One of the most consequential cases of the 2022 term involved the court's 6-3 ruling to end affirmative action in higher education. On June 29, 2023, the Supreme Court struck down race-conscious college admissions programs at Harvard and the University of North Carolina, citing violation of the 14th Amendment's Equal Protection Clause. Chief Justice John Roberts delivered the majority opinion and Justice Sonia Sotomayor wrote the Court's dissenting view. In a rare occurrence, Justice Clarence Thomas spoke from the bench with his concurring opinion.
