Secretary Schmidt was among several other state and local election officials who discussed their previous experience with harassment and the measures taken to secure the election process. Several topics were addressed, including cybersecurity concerns, security and threat mitigation, election workforce challenges, and the role of the federal government in helping to secure elections.

This case dates to 2018 when Steve Elster tried to get the phrase trademarked so he could use it on t-shirts. His application to the Patent and Trademark Office (PTO) was rejected. They cited the proposed trademark is prohibited under the Lanham Act which bans marks identifying a living individual without that person's consent. On appeal, the Trademark Trial and Appeal Board agreed with the decision to reject the application. Mr. Elster argues this denial violates his free speech rights. The Supreme Court has through June 2024 to issue a ruling.
